Quais as vantagens e desvantagens do simples nacional?

O sistema de tributação brasileiro é bastante complexo. Só de ouvir a palavra “imposto”, muitos empreendedores já tremem. No entanto, conhecer como funciona minimamente a legislação, quais os impostos que a sua empresa deve recolher e como se organizar para otimizar sua carga tributária são atitudes que podem evitar grandes problemas para o futuro de muitas empresas. Mesmo se tratando de um sistema complexo, muitas iniciativas foram criadas com o objetivo de facilitar o recolhimento dos impostos e também o dia a dia das empresas. Uma dessas iniciativas é o Simples Nacional, um sistema de arrecadação único que, como o próprio nome diz, pretende descomplicar a tributação das micro e pequenas empresas.

O que é o Simples Nacional

Criado pela Lei Complementar n.º 124/06, o Simples unifica o recolhimento de tributos municipais, estaduais e federais. Isso significa que as empresas que aderem ao Simples contam com uma guia única para pagar os seguintes tributos: IRPJ, CSLL, PIS e COFINS, IPI (impostos federais), ICMS (impostos estadual), ISS (imposto municipal), além de recolher o INSS Patronal para a Previdência Social.

Nem todas as empresas podem optar pelo Simples, já que existem dois pontos principais que devem ser seguidos: o enquadramento dos CNAEs permitidos no Simples e o limite de faturamento que devem ser atendidos para que a empresa escolha esse regime de tributação. Segundo a legislação, podem ser tributadas pelo Simples empresas de faturamento que é até R$ 360 mil/ano e as empresas de pequeno porte que faturam até R$ 3,6 milhões ao ano. Empresas que não atendem a esse padrão de faturamento e CNAEs permitidos devem optar por outros regimes como o lucro real ou lucro presumido.

Em algumas situações, o empreendedor tem a opção de escolher entre o lucro presumido e o Simples e é justamente nessas situações que o empreendedor se sente inseguro de tomar sua decisão. Nunca descarte a possibilidade de conversar com um contador e checar qual a melhor opção para o seu negócio.

 

Vantagens do Simples

Existem diversas vantagens para as empresas que optam pelo Simples. A primeira delas, obviamente, é a unificação da arrecadação, facilitando o recolhimento dos impostos. A arrecadação também é feita com uma alíquota única, o que significa para o empreendedor uma redução de 40% da sua carga tributária, em muitos casos.

Com o Simples também não há a necessidade do registro nos cadastros estaduais e municipais. A própria contabilidade da empresa passa a ser menos complicada, na medida em que o cálculo e o recolhimento dos tributos são feitos de uma vez só. A contabilidade, naturalmente, também é realizada de forma bem mais simples.

Por fim, a empresa ainda conta com uma redução dos custos trabalhistas, já que se torna dispensável a contribuição de 20% do INSS Patronal na folha de pagamento.

Desvantagens do Simples

Porém, existem desvantagens também. Como o Simples unifica o recolhimento dos tributos, as empresas acabam não se valendo dos créditos cumulativos do IPI, ICMS, PIS e COFINS. Para empresas que adquirem insumos para o processo de industrialização, ou que fazem a revenda de produtos, essa característica do Simples acaba sendo pouco vantajosa.

Outra desvantagem do Simples é que, como o recolhimento é feito com base no faturamento e não no lucro, mesmo com a sua empresa tendo prejuízo, a carga tributária será a mesma.

Para determinadas atividades, o Simples acaba não valendo a pena em razão da alíquota. O ideal é analisar cada caso deforma concreta antes de tomar a decisão pelo regime tributário. No entanto, uma regra acaba sendo adotada por boa parte dos empreendedores: quanto maior os gastos com a folha de pagamento, maior a vantagem de se adotar o Simples.

As empresas de pequeno porte, quando tributam pelo Simples, possuem um limite extra decorrente das exportações. Isso significa que a empresa pode recolher pelo Simples desde que sua receita bruta anual declarada seja de R$ 7,2 milhões, sendo R$ 3,6 milhões de mercado interno e R$ 3,6 milhões de exportação de mercadorias e serviços. Essa limitação pode ser um fator que desencoraje muitos empreendedores a crescer, já que alterando o regime tributário, a carga pode ser maior.

O Simples é um regime tributário facultativo, ou seja, o empreendedor pode aderir ao regime ou não. Para saber se o Simples é a melhor opção para a sua empresa não existe uma receita pronta. O ideal é checar mesmo caso a caso e solicitar o auxilio do seu contador quando for necessário. A tributação não foi feita para gerar temor ao empreendedor, porém para lidar com esse fator de forma positiva, é necessário ser estratégico.

Se você tem dúvidas sobre a melhor decisão a tomar, o melhor é não hesitar ou pagar para ver. Até porque em termos de tributação essa conta costuma sair cara. Investir em uma consultoria contábil ou ainda em um planejamento tributário pode ser uma opção econômica e bastante inteligente.
