Simples Nacional “Universal”

 

O governo pretende universalizar o Simples Nacional e adotar a classificação pelo porte da empresa, e não pela atividade, para permitir seu ingresso no regime unificado de tributos. O ministro da Secretaria da Micro e Pequena Empresa, Guilherme Afif Domingos, espera que a medida seja aprovada até o fim do ano pelo Congresso Nacional. Em até 12 meses, Afif ainda pretende colocar em prática um processo único para abertura e encerramento de empresas.
As propostas foram apresentadas pelo ministro ontem, em São Paulo, durante audiência pública para discutir o Projeto de Lei Complementar 237/12. O evento se repetirá em Belo Horizonte (dia 7) e termina dia 10 em Brasília, quando o deputado federal Cláudio Puty (PT) pretende apresentar o substitutivo do projeto com as sugestões.Afif denominou as propostas como “ações transformadoras”. “Pensar simples é um mantra, uma obsessão que temos que levar daqui para frente”, disse. O ministro dividiu as propostas em três linhas de atuação.
A primeira inclui o fim da substituição tributária para empresas no regime, a unificação de obrigações como FGTS e Caged, a facilitação da abertura e fechamento de empresas por meio de uma rede unificada, a Redesim, e o modelo simplificado de tributação para todas as categorias de empreendedores com Faturamento anual de até R$ 3,6 milhões.
Essa última proposta, se aprovada, vai impactar no cotidiano de empresários como André Fernandes, que há 15 anos administra uma consultoria na área de alimentos em Jundiaí, cidade do interior paulista. Com Faturamento anual entre R$ 250 mil e R$ 350 mil, a MV Engenharia mantém um portfólio de clientes de peso, como Pepsico e Nestlé. Um negócio que, segundo Fernandes, “segue bem, mas poderia estar melhor”. “Fico pensando: ‘meu Faturamento cabe no Simples tranquilamente’. Mas por ser uma empresa de consultoria, não posso aderir ao sistema. Se fosse diferente, isso representaria uma Economia importante e isso traria reflexos para a empresa”, destaca o empresário.
Na ponta do lápis, Fernandes calcula que uma possível migração do Lucro Presumido, seu sistema atual, para o Simples Nacional traria uma Economia entre R$ 30 mil a R$ 50 mil por ano. Isso, ele diz, levando em conta a queda da Carga Tributária e os custos operacionais gerados pela contabilidade, que no Lucro Presumido demandam um volume maior de processos e mão de obra. “Isso daria condição de contratar de um a dois funcionários para melhorar o atendimento e ampliar a empresa”, destaca Fernandes, que tem três empregados fixos.
Complemento. Afif também apresentou propostas para eliminar algumas exigências para facilitar a participação das micro e pequenas empresas em licitações. Na terceira linha de atuação, o ministro estuda maneiras para fazer dos pequenos empreendimentos a porta de entrada dos jovens no mercado de trabalho por meio do programa Jovem Aprendiz.
A proposta que deve enfrentar mais resistência é a que encerrar a substituição tributária. No regime, o pagamento do ICMS é antecipado no início da cadeia produtiva e o cálculo é feito em cima de uma base presumida de Preço final, o que torna os desembolsos maiores.

Fim da substituição para empresas optantes do Simples. O regime faz com que as empresas paguem alíquota maior.
Certidões
Eliminar exigências para participação em licitações e exigir uma certidão: a da Previdência Social.
Abertura de empresa
Facilitar a abertura e fechamento de negócios por meio da integração de sistemas e um cadastro digital unificado, a Redesim.
Jovem Aprendiz
Incluir as micro e pequenas empresas na Lei do Jovem Aprendiz como estímulo e não obrigação.
